1. Agreement to Terms
These Terms and Conditions constitute a binding agreement between the service provider ("Provider") and the individual receiving services ("Participant"), guardian, or authorized representative. By enrolling in or receiving Home-Delivered Meals or Daily Meals services, the Participant agrees to comply with all terms outlined in this document.
2. Scope of Services
The Provider agrees to make Home-Delivered Meals and/or Daily Meals available in accordance with the approved service plan, applicable waiver requirements, and state and federal regulations. Services are limited to those authorized and may not exceed approved frequency or duration.
3. Service Modification, Suspension, or Termination
The Provider reserves the right to modify, suspend, or discontinue services if eligibility changes, authorization expires, health or safety concerns arise, access to the residence is denied, or if the Participant repeatedly fails to comply with these Terms and Conditions. Services may also be withdrawn due to emergencies, inclement weather, staffing limitations, or circumstances beyond the Provider’s control.
4. Financial Terms and Billing
Meals are billed only as authorized under the applicable waiver or funding source. The Provider is not responsible for services denied due to lack of authorization, missed deliveries caused by Participant unavailability, or services rendered outside approved guidelines.
5. Participant Responsibilities and Conduct

6. Dignity, Privacy, and Confidentiality
The Provider will respect the Participant’s dignity, privacy, and confidentiality at all times. Information will be shared only as necessary for service coordination, billing, emergencies, or as required by law.
7. Food Safety and Liability
The Provider ensures meals are prepared, handled, and delivered in compliance with all food safety regulations. Responsibility for proper storage and reheating transfers to the Participant upon delivery. The Provider is not liable for illness or injury resulting from improper storage or handling after delivery.
8. Intellectual Property and Materials
Any educational materials, menus, written instructions, or documents provided remain the intellectual property of the Provider and may not be reproduced, distributed, or used for commercial purposes without written permission.
9. Limitation of Liability
The Provider is not liable for service interruptions, delivery delays, or errors caused by circumstances beyond reasonable control, including weather events, transportation issues, or system outages. Services are provided on an "as available" basis within authorized limits.
10. Complaints, Grievances, and Appeals
Participants have the right to file complaints or grievances without fear of retaliation. The Provider will supply information on the grievance and appeal process upon request.
11. Amendments to Terms
The Provider reserves the right to update or revise these Terms and Conditions as required by regulatory changes or operational needs. Participants will be notified of material changes.
12. Acknowledgment and Acceptance
Receipt of Home-Delivered Meals or Daily Meals services signifies understanding, acceptance, and agreement to these Terms and Conditions.
1. Applicability
This Return and Refund Policy applies to Home-Delivered Meals and Daily Meals services provided by the Provider. Due to the nature of food services, returns and refunds are limited and governed by health, safety, and funding regulations.
2. Terms of Return
Meals must be reported for return or refund consideration within 24 hours of delivery. Requests made after this timeframe may not be eligible for review.
3. State of Return
Returned meals must be uneaten, unopened, and in their original packaging. For food safety reasons, meals that have been opened, reheated, or partially consumed cannot be returned.
4. Reasons for Return or Refund
Returns or refunds may be considered under the following circumstances:
Refunds will not be issued for personal preference, missed deliveries due to participant unavailability, or improper storage after delivery.
5. Return Process
To initiate a return or refund request, the Participant or authorized representative must contact the Provider’s customer service or care coordinator within the required timeframe. Documentation such as photographs or delivery records may be requested to support the claim.
6. Refund Process
Approved refunds will be processed in accordance with the applicable funding source or waiver guidelines. Refunds are typically issued within 10–14 business days once the request is approved. No cash refunds are provided.
7. Payment and Funding Limitations
Refunds are subject to waiver, payer, and authorization requirements. The Provider is not responsible for reimbursement of services denied by the funding source.
